The Department engages with the child's family extensively, aiming for voluntary interventions that minimize intrusion while ensuring the child's safety. The DCS Program Manager's approval is sought before any child is removed, ensuring a judicious approach to temporary custody.

 

Procedures for Temporary Custody

Several criteria must be met for temporary custody, such as the absence of less intrusive alternatives and potential harm to the child's health or safety. The child's parents or guardians may consent, or court orders may be obtained based on dependency petitions or exigent circumstances. The child is to be returned within 72 hours unless a dependency petition is filed or a Voluntary Placement Agreement is made.

 

Communication and Documentation

When taking temporary custody, the DCS Specialist communicates transparently with parents, explaining the reasons and the process. Information about the child's needs, medical history, and contacts is gathered. Verbal and written notifications, including Temporary Custody Notices, are provided promptly. Consent from parents for temporary custody obviates the need for court authorization.

 

Dependency Process

The filing of a dependency petition may extend temporary custody, considering imminent danger and the in-home safety analysis. Court authorization is sought through a detailed application process, involving the professional qualifications of the DCS Specialist, specific danger conditions, and reasons for temporary custody. Approval expires 72 hours after execution, excluding weekends and holidays.

 

Exigent Circumstances

Temporary custody without court authorization is permissible in exigent circumstances, such as immediate danger or suspicion of a serious offense. A child's removal for a medical examination must be promptly communicated, and if abuse is confirmed, decisions regarding continued custody are made within 72 hours.

 

Notice of Removal

When removing a child, verbal and written notifications are provided to parents or guardians within six hours, or 24 hours if out-of-state. If a child is already a court ward, removal processes differ based on whether the child remains at home or is in out-of-home care. Procedures ensure legal and ethical communication with caregivers and parties involved.

 

Supervisor and Program Manager Approval

Supervisory discussion and Program Manager approval are mandatory before any temporary custody actions. Consultation with the Program Manager is essential, ensuring a comprehensive assessment of the situation. In exigent circumstances, immediate removal is allowed, with subsequent consultation with the Program Manager.

 

Documentation and Reporting

Complete and detailed documentation is maintained, encompassing reasons for removal, deprivation factors, living arrangements, and medical information. Reports and court filings are submitted as required by law, ensuring transparency and adherence to legal protocols. The importance of confidentiality is recognized and adhered to during documentation.
